By accessing and using SponsorSafe HR ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

SponsorSafe HR provides HR and sponsor licence record-keeping software for UK employers. The Service includes employee record management, document storage, compliance tracking, and reporting features.

Important: SponsorSafe HR is not endorsed by the Home Office. This Service is a record-keeping tool and does not guarantee compliance with UK immigration law. You remain fully responsible for meeting all sponsor licence obligations and compliance requirements.

3. User Accounts

You must create an account to use the Service. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring all information provided is accurate and current

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Share your account credentials with unauthorized users
  • Use the Service to store data you do not have the right to process

5. Data and Privacy

You retain all rights to the data you upload to the Service. By using the Service, you grant us permission to process your data solely for the purpose of providing the Service.

You are the data controller for any personal data you process using the Service. You are responsible for ensuring your use of the Service complies with GDPR and UK data protection laws.

6. Payment and Billing

Subscription fees are billed annually in advance. All fees are non-refundable except as required by law or as stated in our 30-day money-back guarantee.

We reserve the right to change our pricing with 30 days' notice. Price changes will not affect your current billing cycle.

If payment fails, we may suspend your access to the Service until payment is received.

7. Cancellation and Termination

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

We may suspend or terminate your account if you violate these Terms or engage in fraudulent activity.

Upon termination, your account will be downgraded to read-only mode for 90 days, allowing you to export your data. After 90 days, all data will be permanently deleted.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Intellectual Property

The Service, including all software, designs, and content, is owned by SponsorSafe HR and protected by copyright and other intellectual property laws.

You may not copy, modify, distribute, or reverse engineer any part of the Service without our written permission.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
